If a tenant has not been around for over 6 months and not paid any rent, can I clean out the apartment and re-rent it?
Yes. You can get an eviction order for non-payment. The sheriff will move the tenant's belongings out. In some cases you must first give a statutory notice of abaondment for 15-20 days to the last known address before changing the locks. Also if the tenant's property has a material value, e.g., over $300, the landlord cannot throw it away.
